1. Acceptance of Terms
By accessing or using Recast (the "Service") provided by Reinadelatlas LTD. ("Company", "we", "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you must not use the Service.
These Terms apply to all users of the Service, including visitors, subscribers, and content contributors.
2. Description of the Service
Recast is an automated content repurposing and distribution platform that enables users to connect content sources (YouTube, Twitch, podcast feeds, etc.) and automatically publish formatted content to multiple destinations (TikTok, Instagram, LinkedIn, etc.).
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes where possible.
3. Accounts & Registration
To access the Service you must create an account with a valid email address. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use of your account at security@recast.io.
Accounts may not be shared between multiple individuals. Agency plan customers may add up to 10 team members through the workspace management feature.
4. Billing & Payment
Recast offers three monthly subscription plans: Starter (49,90 €/mo), Creator (69,90 €/mo), and Agency (89,90 €/mo). All plans are billed monthly in advance.
A day-access option is available at 2,85 €, allowing use of the Service for a 24-hour period. Day-access is non-refundable once activated.
All prices are inclusive of applicable VAT. Payment is processed via Stripe. By providing payment information, you authorize us to charge your payment method on the applicable billing cycle.
Failure to pay may result in suspension of your account. We will notify you by email before suspending access.
5. Your Content
You retain full ownership of all content you create, upload, or distribute through the Service ("User Content"). By using Recast, you grant us a limited, non-exclusive, royalty-free license to process, store, format, and transmit your User Content solely as required to provide the Service.
You represent and warrant that:
- You own or have the necessary rights and permissions to use and distribute your User Content.
- Your User Content does not infringe on the intellectual property, privacy, or other rights of any third party.
- Your User Content complies with all applicable laws and the platform policies of connected destinations.
6. Prohibited Uses
You agree not to use the Service to:
- Distribute spam, unsolicited bulk communications, or automated harassment.
- Publish content that is defamatory, obscene, fraudulent, or violates any applicable law.
- Circumvent, disable, or interfere with security features of the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to infringe on the intellectual property rights of third parties.
- Share, resell, or sublicense access to the Service without express written consent.
- Create multiple accounts to circumvent usage limits or subscription requirements.
Violation of these prohibitions may result in immediate account termination without refund.
7. Intellectual Property
The Service, including its software, design, trademarks, logos, and all underlying technology, is owned by Reinadelatlas LTD. and protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.
The "Recast" name and logo are registered trademarks of Reinadelatlas LTD. You may not use our trademarks without prior written permission.
8. Third-Party Services & Integrations
The Service integrates with third-party platforms (YouTube, TikTok, Instagram, Spotify, etc.). Your use of those platforms is subject to their own terms of service and privacy policies. We are not responsible for the availability, performance, or content policies of third-party platforms.
If a third-party platform changes its API or policies in a way that limits our integration, we will endeavor to restore functionality but cannot guarantee uninterrupted service.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We make no guarantees regarding the accuracy or reliability of content processing outcomes.
10. Limitation of Liability
To the fullest extent permitted by law, Reinadelatlas LTD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Termination
You may cancel your account at any time through your account settings or via the Unsubscribe tool on our website. We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including IP rights, disclaimers, and limitations of liability) shall survive.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
If you are a consumer in the EU, you may also have rights under the mandatory consumer protection laws of your country of residence, which these Terms do not override.
